1. Scope
These general terms and conditions govern the contractual relationship between Casa Cafaro, sole proprietorship Alessandra Cafaro, Flurweg 33, 3072 Ostermundigen, Switzerland (hereinafter Casa Cafaro or we), and customers for all orders and purchases in the online shop at casacafaro.ch.
By placing an order, the customer accepts these terms in the version valid at the time of the order.
2. Offer and products
The products and prices shown in the online shop are a non-binding offer and may be adjusted at any time.
Images, product descriptions or information on scent, colour or shape are for illustration and are not binding.
All products are made with the greatest possible care and comply with the applicable Swiss regulations for cosmetic products and consumer goods.
3. Conclusion of contract
A contract is only concluded when Casa Cafaro confirms the customer’s order (for example by e-mail) or ships the ordered goods.
Casa Cafaro reserves the right to decline orders without giving reasons.
4. Prices
All prices are in Swiss francs (CHF).
Casa Cafaro is not subject to VAT; prices do not include VAT. Unless stated otherwise, prices exclude shipping costs.
Prices may change at any time; the price at the time of the order applies.
5. Payment methods
The online shop offers the following payment methods: credit card, TWINT, Apple Pay and Google Pay via the payment provider Stripe, as well as prepayment by invoice.
Goods are shipped only after receipt of payment. Payment is deemed made as soon as the amount has been credited to Casa Cafaro’s account.
6. Delivery
Delivery is made by Swiss Post to the address given by the customer within Switzerland. The options are:
- B-Post: delivered within three days.
- A-Post: ordered by 2 pm, delivered the next day, otherwise the day after; no Saturday delivery.
- Express: ordered by 4 pm, delivered the next day, Saturdays included.
Shipping costs are shown during checkout and depend on weight and shipping method.
Casa Cafaro is not liable for delays or damage occurring in transit or caused by third parties.
Collection in Bern is possible by prior arrangement.
7. Returns
Casa Cafaro grants a voluntary right of return of 10 days from receipt of the goods.
Returns are only possible if the products are unopened, unused, undamaged and in their original packaging. The customer bears the cost of the return. Returns without prior contact will not be accepted.
After receipt and inspection of the returned goods, the purchase price (less any shipping costs) is refunded to the payment method used for the order.
Excluded from the right of return are:
- products that have been opened or used,
- individualised or personalised items,
- digital content and services (once performance has begun).
8. Liability
Casa Cafaro undertakes to deliver products of flawless quality.
Should a defect nevertheless occur, it must be reported in writing within 5 days of receipt. If the complaint is justified, the product will be replaced or the purchase price refunded. Further claims are excluded.
Casa Cafaro is not liable for slight negligence, indirect damage, consequential damage or loss of profit. In any case, liability is limited to the purchase price of the product concerned.
Customers are obliged to use products properly and to observe application and storage instructions (for example protection from sun and heat).
9. Availability and changes
Casa Cafaro reserves the right to remove products from the range, adjust prices or temporarily close the online shop at any time without notice. Such changes do not give rise to any claim for damages.
10. Intellectual property
All texts, images, designs and content on the website are protected by copyright and are the property of Casa Cafaro or the respective rights holders. Any use or reproduction without express consent is prohibited.
11. Data protection
The protection of personal data is important to us. Personal data is used exclusively for order processing, communication and, where expressly consented to, for marketing purposes. Further information can be found in the privacy policy.
12. Applicable law and place of jurisdiction
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Bern, Switzerland.
13. Severability
Should individual provisions of these terms be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be deemed replaced by an economically sensible provision that comes closest to the original purpose.
